Terms of Use
The short version
- MyVisitVault helps you keep your own records of medical visits. It isn't medical advice and isn't for emergencies.
- Only enter, record and share information you have the right to.
- Your records belong to you.
- Subscriptions are billed and cancelled through Apple or Google.
- Keep your backup password safe: we can't recover it.
1. These terms
These terms are an agreement between you and MyVisitVault LLC, a Virginia limited liability company ("we", "us") for using the MyVisitVault app and services. By creating an account or using MyVisitVault, you agree to them. Our Privacy Notice explains how we handle information. If you join our beta, the Beta Terms also apply.
2. Who can use MyVisitVault
You must be at least 18 years old and live in the United States. You may keep records about other people, including children, when you are allowed to (see section 4).
3. What MyVisitVault is, and isn't
- MyVisitVault is a record-keeping tool for caregivers. It helps you capture visit notes and recordings and keep lists of medications, diagnoses and procedures.
- It isn't medical advice. It doesn't diagnose, treat or prevent any condition, and it doesn't replace a doctor or other healthcare professional. Always follow the care team's instructions.
- It isn't for emergencies. In an emergency, call 911.
- Transcripts and summaries are generated automatically and can be incomplete or wrong. Check anything important against the visit itself or with the care team.
- Notifications and syncing between phones depend on the phones, networks and services involved, and may be delayed.
4. Your responsibility for the information you add
- Only enter information about another person, or share it, if you have their permission or the legal authority to do so. For example, you may be their parent, guardian, healthcare agent or authorized caregiver.
- Recording: recording laws differ by state, and some require everyone's permission. Get permission from everyone you record before you start. The app asks you to confirm this, but getting permission is your responsibility.
- Provider and facility policies: many doctors, clinics and hospitals have their own rules about recording, and you may already have agreed to one, for example in paperwork you signed. It's your responsibility to know and follow any such policy before you record.
- Only invite people you want to see a person's records. Once shared, those caregivers keep copies on their phones.
5. Acceptable use
Don't use MyVisitVault to:
- harass, threaten, bully or impersonate anyone;
- record anyone you don't have permission to record;
- record in any place where you aren't allowed to record;
- record in a way that breaks a healthcare provider's or facility's policy;
- share information about someone without the permission or authority described above;
- share sexual content, content that exploits children, or illegal content;
- send unwanted or repeated invitations to someone who has declined or asked you to stop;
- break the law or anyone's rights;
- interfere with, overload, probe or reverse engineer the service, or access accounts or data that aren't yours;
- resell the service or use it to build a competing product.
6. Reporting problems and enforcement
You can report a caregiver or content that breaks these terms by emailing [email protected]. You can always stop sharing a person, remove a caregiver or leave a shared person. We review reports and may remove access, suspend or close accounts that break these terms. Because shared records are encrypted and we can't read them, include only the information needed to explain a report.
7. Your records
You own the records you add. You give us only the permission we need to store, transmit, back up and process them to provide the features you use. That includes sending them to our service providers for transcripts and summaries when you ask for them. We don't claim ownership of your records and don't use them for advertising.
8. Plans and subscriptions
- Some features need a paid plan. Plans are sold through the Apple App Store or Google Play. The price and billing period are shown before you buy.
- Subscriptions renew automatically at the same price for the same period until you cancel. Cancel at least 24 hours before the renewal date in your Apple or Google account's subscription settings. You can also start from Account & Plan in the app.
- After you cancel, you keep the plan until the end of the period you paid for.
- Refunds are handled by Apple or Google under their refund policies.
- If we change a price, the store will notify you as its rules require before the new price applies.
- Complimentary or beta access has no charge and doesn't turn into a paid subscription unless you choose to buy one.
9. Backups and passwords
Backups are encrypted with a password only you know. We can't recover it. If you lose the password and don't have another signed-in phone that can reset it, your backup can't be restored. Keep your password somewhere safe, and keep your own copy of anything important.
10. App store terms
If you got MyVisitVault from the Apple App Store, Apple's Licensed Application End User License Agreement also applies. Apple isn't responsible for the app or its support. If you got it from Google Play, the Google Play Terms of Service also apply. If these terms conflict with the store's required terms, the store's terms control for that store.
11. Our software
We own the MyVisitVault app, website and brand. We give you a personal, non-transferable right to use the app under these terms. If you send us feedback, we may use it without owing you anything.
12. Disclaimers
To the extent the law allows, MyVisitVault is provided "as is" and "as available", without warranties of any kind, including that it will be uninterrupted, error-free or that data will never be lost. Some states don't allow these exclusions, so they may not all apply to you.
13. Limitation of liability
To the extent the law allows, we aren't liable for indirect, incidental, special or consequential damages, or for lost data or profits. Our total liability for any claim about MyVisitVault is limited to the greater of what you paid us in the 12 months before the claim or $50. Nothing in these terms limits liability that can't be limited by law, or your rights as a consumer that can't be waived.
14. Ending your use
You can stop using MyVisitVault and delete your account at any time (see the Privacy Notice). We may suspend or close an account that breaks these terms, or stop offering the service. If we stop offering it, we'll give reasonable notice so you can keep your records.
15. Changes to these terms
We'll post updated terms here with an effective date and keep earlier versions available. For material changes, we'll tell you in the app or by email before they apply, and ask you to agree when required.
16. Governing law and disputes
These terms are governed by the laws of the Commonwealth of Virginia, except where federal law or the consumer protection law of your state applies. Before starting a claim, please contact us so we can try to resolve it. Claims will be heard in the state courts of Loudoun County, Virginia, or the federal courts for the Eastern District of Virginia. Either of us may use small claims court instead where it's available.
